A Gage County District Court jury Friday afternoon found in favor of the defendants listed as negligent in a lawsuit filed by Kristina Scheele of Marysville. She had suffered traumatic brain injury resulting from an April 9th, 2012 accident six miles south of Beatrice. Thick smoke from a permitted burn led to her colliding with an oncoming semi. Scheele was seeking damages for medical expenses, loss of income, and future earning capacity. Testimony in the trial had indicated that Scheele was unable to maintain her previous employment as a result of the accident. Defendants included Darrell Rains, who had necessary permits for the controlled burn, with the twelve member jury concluding that the defendants were not negligent. The trucking company involved in the accident also argued that the driver had taken appropriate action to avoid an accident. The decision came after nearly three hours of deliberation concluding the weeklong trial in Beatrice.
